I. TERMS OF SERVICE

1. Agreement to Terms

By accessing the website of the Somatic Release & Community Care Initiative (SRCCI) at srccipdx.org, or by participating in our sponsorship program, you agree to be bound by these Terms of Service. SRCCI is a community-based healing justice project of BLKJADE. Mental Wellness, LLC. All professional services are directed by Roxanne Capparelli, LCSW (Oregon License #L11496) and CADC-I (#24-02-11029).

2. Program Mission & Clinical Model

SRCCI facilitates "Clinical Somatic Sponsorships" for BIPOC Portlanders. Our framework is rooted in Healing Justiceand specifically addresses weathering—the physiological toll of systemic oppression.

  • Referral Basis: Sponsorships are provided based on clinical intake to ensure that high-intensity somatic discharge (e.g., smash rooms) is an appropriate tool for your current nervous system state.

  • Non-Clinical Space: While referrals are clinical, the venues themselves are community spaces, not medical facilities.

3. The Voucher Model & Guest Autonomy

A core tenet of SRCCI is the preservation of your dignity and agency.

  • Autonomous Guest Status: You enter partner venues (such as Smash PDX) as an autonomous guest, not as a "patient" or "client."

  • Privacy Firewall: No clinical labels, mental health diagnoses, or treatment histories are shared with venue staff. They are only provided with the information necessary to verify your sponsorship code and identity.

  • Personal Responsibility: You are responsible for your own conduct, physical safety limits, and adherence to the venue's rules.

4. Liability Firewall (Critical Notice)

SRCCI maintains a strict separation of responsibility between clinical support and physical facility safety.

  • Clinical Responsibility (BLKJADE): My responsibility is strictly limited to the intake assessment and the provision of off-site grounding tools.

  • On-Site Liability (The Venue): The partner venue (e.g., Smash PDX) maintains sole and exclusive responsibility for on-site safety protocols, protective equipment (PPE), facility maintenance, and physical safety.

  • Waivers: Participation is contingent upon you signing the venue’s standard liability waiver. BLKJADE. Mental Wellness, LLC does not oversee, verify, or assume liability for the venue's safety briefings or equipment.

5. Limitation of Liability & Indemnification

To the fullest extent permitted by law, BLKJADE. Mental Wellness, LLC and Roxanne Capparelli shall not be liable for any physical injury, property damage, or psychological distress sustained while on-site at a partner venue. By utilizing an SRCCI sponsorship, you agree to indemnify and hold harmless BLKJADE. Mental Wellness, LLC from any claims arising out of your participation at third-party locations.

6. Intellectual Property

The SRCCI framework, the "Somatic Menu," and all clinical grounding materials on this site are the intellectual property of BLKJADE. Mental Wellness, LLC. You may not reproduce or distribute these materials for commercial purposes without explicit written consent.

II. PRIVACY POLICY & NOTICE OF PRIVACY PRACTICES

1. Our Commitment to Privacy

As a Licensed Clinical Social Worker, I maintain the highest standards of confidentiality. This policy outlines how I handle both general website data and sensitive Protected Health Information (PHI).

2. Information We Collect

  • Clinical Intake Data: Sensitive information regarding your trauma history, stressors, and mental health. This is stored on secure, HIPAA-compliant platforms (e.g., SimplePractice or equivalent).

  • Identity Data: Name and contact information used to facilitate voucher distribution.

  • Usage Data: Standard analytics (IP addresses, browser types) used to optimize website performance.

3. How Information is Shared

  • With Venues: We share only your name and sponsorship code. We NEVER share clinical notes or diagnoses with partner venues.

  • By Law: We may disclose information if required by Oregon law (e.g., mandated reporting regarding child/elder abuse or immediate threats of harm to self or others).

4. Your Data Rights

You have the right to request a copy of your records, request amendments to your data, and revoke your consent for data sharing at any time (which may impact your sponsorship eligibility).

III. COOKIE POLICY

1. Use of Cookies

srccipdx.org uses cookies to ensure site functionality and to help us understand which resources are most helpful to the community.

2. Cookie Categories

Essential: Required for site security and navigation.

Analytical: Uses Google Analytics to track site traffic patterns anonymously.

Functional: Remembers your preferences for future visits.

3. Control

You may disable cookies in your browser settings. This may prevent some features of the "Somatic Menu" or intake forms from functioning correctly.

IV. CLINICAL & EMERGENCY DISCLAIMER

1. Not a Substitute for Professional Care

The content on this website is for informational and educational purposes regarding somatic release. It is not a substitute for individual medical advice, diagnosis, or traditional psychotherapy.

2. No Therapist-Patient Relationship

Visiting this site or submitting an inquiry form does not establish a formal therapist-patient relationship. A clinical relationship is only established after a formal intake and the signing of a Professional Disclosure Statement.
